BlackWay Car Service LLC ("BlackWay," "Company," "we," "our," or "us") respects your privacy and is committed to protecting the personal information you provide when you request, book, pay for, or use transportation services arranged through us.

Our services are primarily directed to customers in the United States, including New York and surrounding service areas.

2.Who We Are

BlackWay Car Service LLC is a limited liability company registered in the State of Montana. BlackWay provides reservation, dispatch, coordination, and customer-support services for ground transportation.

BlackWay may arrange transportation through independent transportation providers and chauffeurs. Unless expressly stated otherwise for a particular service, transportation may be performed by independent providers using their own vehicles, drivers, licenses, permits, and insurance. BlackWay's role may include receiving reservations, coordinating trips, communicating trip details, processing or facilitating payments, and providing customer support.

BlackWay is responsible for the personal information it collects and uses for its own business purposes. Independent transportation providers may separately collect and maintain information under their own privacy practices and legal obligations.

3.Information We Collect

We may collect information you provide directly, information collected automatically when you use our website or services, and information received from third parties.

3.1Information you provide directly

  • Billing information and payment information.
  • Pickup and drop-off addresses.
  • Pickup date and time.
  • Flight information, including airline, flight number, arrival date, and scheduled arrival time.
  • Number of passengers and luggage information.
  • Child-seat, accessibility, vehicle, and other special requests.
  • Booking, reservation, cancellation, and trip information.
  • Communications with our staff, including emails, SMS/text messages, chats, and customer-support records.
  • Information contained in complaints, photographs, screenshots, receipts, or other materials you voluntarily provide.
  • Information required to verify a payment or investigate suspected fraud.
  • Call recordings where calls are recorded in accordance with applicable law and where notice is provided.

3.2Payment information

We may receive payment card information when you choose to provide it to us for payment processing. We may also use payment processors such as Stripe to process transactions. Where payment information is handled by a payment processor, that processor may process the information under its own privacy policy and security procedures.

We do not retain card security codes such as CVV/CVC after authorization. Where customers provide full card information directly to BlackWay, we use it only for the requested payment or related authorized transaction and follow reasonable procedures to remove it after it is no longer needed.

3.3Information collected automatically

When you visit our website, we may automatically collect information such as IP address, browser type, operating system, device information, language preferences, pages viewed, referring pages, access times, and other website usage information.

3.4Cookies and similar technologies

Transportation providers and chauffeurs — We may provide information needed to perform a trip, including passenger name, telephone number, pickup and drop-off locations, flight details, and special instructions.

Payment processors and financial institutions — We may disclose payment information to processors such as Stripe and to financial institutions, card networks, or other parties involved in processing or resolving transactions.

Service providers — We may disclose information to vendors that host systems, provide communications, customer-support tools, analytics, security, payment processing, or other services for BlackWay.

Advertising and analytics providers — We may disclose online identifiers and website activity to providers such as Google where necessary for advertising, analytics, measurement, and related purposes.

Professional advisers and insurers — We may disclose information to attorneys, accountants, insurers, auditors, or other professional advisers when reasonably necessary.

Law enforcement and authorities — We may disclose information where required by law, legal process, or governmental request, or when reasonably necessary to protect rights, safety, or property.

9.Payment Information and Card Data

BlackWay may offer secure payment links or payment processing through third-party processors. Customers may also provide card information directly when requesting that BlackWay process a payment.

If you provide full card information directly to us, we use it only for the authorized payment or related transaction. We do not retain CVV/CVC/CID security codes after authorization. Card information that is no longer needed is deleted or securely disposed of in accordance with our internal procedures.

Where a payment processor provides a token or other non-sensitive payment reference, BlackWay may retain that reference, together with limited transaction information, for payment records, refunds, customer service, fraud prevention, and dispute resolution.

We limit access to payment information to personnel and service providers who have a legitimate business need to use it.

10.Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including providing services, maintaining business and financial records, resolving disputes, preventing fraud, complying with legal obligations, and protecting our rights.

Our intended standard retention practices include:

Booking and trip records:
generally 7 years from the date of travel.
Payment transaction records and payment tokens:
generally 7 years from the transaction.
Card information provided directly for a payment:
deleted after authorization and, where practicable, within 24 hours.
Card security codes:
not retained after authorization.
Government-issued identification used for verification:
generally deleted within 30 days, subject to legitimate legal or dispute-related needs.
Customer-support and complaint records:
generally 3 years, or longer when associated with a claim or dispute.
Call recordings:
generally 2 to 3 years, or longer when needed for a related complaint, dispute, chargeback, investigation, or claim.
Incident, injury, or vehicle-damage records:
generally 7 years, or longer where required or reasonably necessary for a legal matter.
Accessibility request information:
generally 12 months after the trip.
Marketing contact information:
until you opt out or after an extended period of inactivity, generally 24 months.
SMS consent and opt-out records:
generally 6 years after consent is withdrawn or after the consent was last relied upon.
Website analytics information:
generally 2 to 3 years, depending on the applicable platform and configuration.
Session recordings, if used:
generally up to 12 months.
Security and server logs:
generally 12 months, with longer retention where reasonably necessary to investigate a security incident.

These periods are guidelines rather than guarantees. We may retain information longer where necessary for legal claims, audits, investigations, regulatory requirements, payment disputes, fraud prevention, insurance matters, or other legitimate business purposes.

When information is no longer needed, we delete it or irreversibly anonymize it where reasonably practicable.

11.Your Privacy Rights

Depending on where you live and applicable law, you may have rights concerning your personal information, including the right to know or access information we hold about you, request deletion, request correction of inaccurate information, obtain certain information in a portable format, and opt out of certain sales or sharing for targeted advertising.

12.Marketing Communications and SMS

We distinguish between transactional communications and marketing communications.

Transactional messages — We may send SMS, email, or other communications relating to a reservation or service you requested, including booking confirmations, receipts, driver or vehicle information, pickup reminders, trip updates, changes, cancellations, and responses to customer inquiries. These communications are part of providing the requested service.

Marketing messages — We may send promotional or marketing messages only where permitted by applicable law and, where required, after obtaining the appropriate consent.

SMS consent — Where marketing SMS consent is collected through our website or another channel, the consent request will be presented separately from acceptance of our Terms of Service and Privacy Policy where required. Marketing SMS consent is not a condition of purchasing transportation services.

The disclosure presented at the time of consent may explain that messages are recurring, message frequency may vary, message and data rates may apply, consent is not a condition of purchase, and that the customer can reply STOP to unsubscribe or HELP for assistance.

We maintain records of SMS consent, including information such as the date and time of opt-in, method of consent, the disclosure presented, and opt-out information, as reasonably necessary to demonstrate compliance.

You may opt out of marketing SMS by replying STOP to a marketing message. You may request assistance by replying HELP. Opting out of marketing messages does not prevent necessary transactional communications related to an active or requested service.

We do not sell or rent telephone numbers or SMS consent records to third parties for their own marketing purposes.

13.Call Recording

Calls to or from BlackWay may be recorded for purposes such as quality assurance, training, reservation accuracy, customer support, payment verification, fraud prevention, dispute resolution, and security.

Where required by applicable law, we provide notice of recording at the beginning of the call. By continuing a call after receiving any legally required recording notice, you may be deemed to have consented where the law permits consent in that manner.

Call recordings are handled as business records and are subject to the retention practices described in this policy.

14.Automated Decision-Making and Profiling

BlackWay does not use fully automated decision-making that produces legal or similarly significant effects concerning customers.

Payment processors or fraud-prevention systems may generate risk indicators. BlackWay may review such information when deciding whether additional verification or other action is appropriate.

Advertising and analytics technologies may be used to create audience segments or measure advertising performance. These activities do not determine the price of transportation or your eligibility to receive transportation services.

15.How We Protect Your Information

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, misuse, alteration, disclosure, and loss.

Safeguards may include access controls, authentication, restricted employee access, secure transmission, vendor security controls, payment processors, and monitoring of systems and accounts.

No method of internet transmission or electronic storage is completely secure. We cannot guarantee absolute security. If we become aware of a security incident affecting personal information, we will provide notices required by applicable law.

16.International Visitors

Our services are primarily directed to customers in the United States and transportation arranged by BlackWay is generally performed in the United States.

Customers visiting the United States from other countries may use our website or services. Personal information may be processed and stored in the United States and may be subject to U.S. laws that differ from those in the customer's home country.

Where applicable law gives an international visitor privacy rights, BlackWay will consider and respond to valid requests in accordance with that law.

17.Children's Privacy

Our website and transportation reservation services are intended primarily for adults. We do not knowingly collect personal information directly from children in violation of applicable law.

Minors may travel as passengers when an adult makes a reservation. In that situation, the adult making the reservation is responsible for providing necessary passenger information and for complying with applicable requirements.

If you believe that a child has provided personal information directly to BlackWay in circumstances where it should not have been collected, please contact us so we can review and take appropriate action.

18.Third-Party Links and Services

Our website or communications may contain links to or integrations with third-party websites, applications, payment processors, mapping services, advertising platforms, analytics services, booking systems, and other services.

Those third parties may have their own privacy policies and practices. BlackWay is not responsible for the privacy practices of third parties that operate independently of us. We encourage you to review the privacy policy of any third-party service you use.
